Agreement to Terms

By accessing or using Simcha 11 (simcha11.com), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms constitute a legally binding agreement between you and Simcha 11.

Description of Service

Simcha 11 is an online service that provides digital invitation card templates for Jewish simchas (Bar Mitzvah, Wedding, Tenoyim, Bris, Kiddush, Upsherin, Sheva Brachos, etc.). Users can browse card designs, customize them with personalized text, and purchase digital files for download. All cards are priced at $11.00 USD per design, unless otherwise marked as free.

User Accounts

Account Creation

You may create an account by signing up with Google or by providing an email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Security

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account information.

Account Deletion

You may delete your account at any time through the Account Settings page. Upon deletion, your personal information will be removed, but order records may be retained for business and legal purposes.

Guest Checkout

You may make a purchase without creating an account (guest checkout). Guest orders are accessible via email for 30 days after purchase. After 30 days, access to guest orders may be limited or removed. For permanent access to your order history, we recommend creating an account.

Purchases and Payments

Pricing

All card designs are priced at $11.00 USD per design unless otherwise marked as free. Prices are subject to change at any time without notice, but changes will not apply to orders already placed.

Payment Processing

Payments are processed through Stripe. By providing payment information, you represent and warrant that you are authorized to use the payment method and that all information is accurate and complete.

No Refunds

All sales are final. Due to the digital nature of our products, we do not offer refunds or exchanges. Once you have purchased and downloaded a card design, the transaction is complete.

Digital Products

Delivery

Upon successful payment, you will receive an email with a download link to your card files. The download link is valid for 30 days. After 30 days, the link may expire and access may require contacting customer support.

File Formats

Cards are provided in high-resolution formats suitable for printing (JPG and PDF). We are not responsible for print quality issues caused by third-party printers or improper printing settings.

Personal Use Only

Purchased card designs are for personal use only. You may not resell, redistribute, or use the designs for commercial purposes without express written permission from Simcha 11.

Intellectual Property

Our Content

All card designs, templates, graphics, text, and other content on the Service are owned by Simcha 11 or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Your Content

By providing custom text for your card design, you represent and warrant that you have the right to use such content and that it does not infringe upon the rights of any third party. You grant Simcha 11 a non-exclusive, royalty-free license to use your content solely for the purpose of fulfilling your order.

Trademarks

The Simcha 11 name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Simcha 11. You may not use our trademarks without our prior written consent.

User Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
• Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Upload or transmit viruses, malware, or any other malicious code.
• Use the Service to harass, abuse, or harm others.
• Use the Service to create or distribute content that is offensive, inappropriate, or violates any laws.
• Reverse engineer, decompile, or disassemble any portion of the Service.

Drafts and Saved Work

You may save drafts of your card designs for later completion. Drafts are stored in your account and can be accessed at any time. We reserve the right to delete drafts after a reasonable period of inactivity or if your account is deleted.

Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease.

Limitation of Liability

To the fullest extent permitted by law, Simcha 11 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service. Our total liability to you for all claims shall not exceed the amount you paid for the Service.

Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Indemnification

You agree to indemnify and hold harmless Simcha 11, its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) resulting from your use of the Service, your violation of these Terms, or your violation of any rights of another.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New York.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
